Blank Rome Secures Final $28M Fuel Arbitration Award for Preble-Rish Haiti, S.A. against Republic of Haiti
A Blank Rome team successfully represented Preble-Rish Haiti, S.A. (“PRH”) in obtaining an arbitration award against the Republic of Haiti and Bureau De Monetisatation De Programmes d’Adie Au Developpment in the amount of $28.2M (USD). The award was issued on August 23, 2022.
In the arbitration, PRH claimed damages for breach of three contracts providing for the supply by PRH of diesel fuel, jet fuel, and gasoline to Haiti. The Republic of Haiti sought a stay of the arbitration in the New York Supreme Court, which was denied. The Blank Rome team were then successful when the Republic’s appeal to the First Department Appellate Division was unanimously denied. Thereafter, the Blank Rome team litigated issues of security in two federal district courts and two circuit courts of appeal.
