Blank Rome Secures $23M Fuel Arbitration Award for Preble-Rish Haiti SA against Republic of Haiti

A Blank Rome team obtained a favorable decision for Preble-Rish Haiti SA, an infrastructure project and materials supply company, in the U.S. District Court for the Southern District of New York, on January 26, 2022, when U.S. District Judge P. Kevin Castel confirmed a $23 million arbitral award against the Republic of Haiti for failing to pay for fuel deliveries, after determining that the Caribbean nation had opportunities to present its case but decided against doing so.

In a formal statement to Law360, Blank Rome’s William R. Bennett III noted that the client is pleased with the judge's decision, which falls in line with previous opinions in the case finding that the arbitration provision in the contract between Preble-Rish and Haiti is valid. "Preble-Rish continues to prosecute its claim for damages and will do so until it is fully paid," Bennett said.
