Biography
Rob Lieber concentrates his practice on consumer finance, gaming, and intellectual property litigation.
As a member of the firm's Financial Institutions Litigation and Regulatory Compliance (“FILARC”) group, Rob represents lenders, mortgage servicers, and other financial institutions in consumer financial services litigation. He has successfully defended clients against claims for breach of contract, fraud, alleged violations of the Truth in Lending Act (“TILA”), Fair Debt Collection Practices Act (“FDCPA”), Real Estate Settlement Procedures Act (“RESPA”), Fair Credit Reporting Act (“FCRA”), and various state law violations. He also advises financial institutions on various regulatory compliance matters. Rob has also assisted clients with loan workouts, title claims, lien superiority issues, and bankruptcy adversary proceedings.
Rob also represents a broad range of gaming industry clients, including casinos, internet gaming operators, sports betting companies, and gaming related vendors. His experience includes defending casinos and individuals within the gaming industry against consumer claims and other unwanted litigation. Rob also advises clients on compliance with sports betting and gaming regulations and licensing issues.
Rob also has experience in representing clients in intellectual property litigation, with an emphasis in trademark infringement actions and counterfeit products enforcement.
Experience
- Assisted in obtaining favorable settlement for client in action involving Rosenthal Fair Debt Collection Practices Act and California’s Unfair Competition Law.
- Obtained favorable settlements and early dismissals on behalf of clients facing FDCPA and related state law claims.
- Assisted in advising regional bank on exit strategy for its insurance premium financing line of business.
- Successfully defended reverse mortgage lender by obtaining dismissal of fraud and elder abuse claims after three-day bench trial.
- Assisted in advising loan servicer regarding state foreclosure laws and regulations.
- Successfully defended to a jury verdict a lender against claim for wrongful foreclosure.
- Obtained summary judgment on behalf of lenders and mortgage servicers against claims of wrongful foreclosure and other claims.
