EEOC Targeting Construction Industry Ahead of Federal Infrastructure Spending Spree

The U.S. Equal Employment Opportunity Commission last spring put the construction industry on notice that its investigators were turning their attention to what the agency called “severe and pervasive discrimination” in the sector, especially for women and people of color.

Susan Bickley, a partner at Blank Rome in Houston, said her sense is that the EEOC has been looking not at one sector, per se, but at field environments, where workers generally aren’t as tightly supervised. That includes not only construction but also oil patch operations. “They’re a little more ‘rough and tumble’ unlike the ordinary office environment.”
