How Gov. Shutdown Would Impact DOL's Wage-Hour Work

A federal government shutdown would effectively halt the work of the U.S. Department of Labor's Wage and Hour Division, leaving workers and employers in a bind, attorneys and other observers said.

"We're talking about investigations being stalled, enforcement actions being stalled," said management-side attorney Alix Udelson of Blank Rome LLP. "Really, everything is going to come to a screeching halt during that lapse."

Employers should keep in mind that they are not off the hook for compliance during the funding lapse, and they should be ready for existing investigations to resume afterward, Blank Rome's Udelson said.

"The laws on wage and hour remain intact," she said. "To the extent investigations had initiated, or audits had initiated, prior to the lapse ... presumably they're going to pick up after the lapse is over."
