Court’s Expansion of Attorney Immunity Could Change How Texas Lawyers Practice

As a transactional attorney, Stephanie Chandler of San Antonio said that a recent Texas Supreme Court ruling will enable her to advise clients without having to second-guess their decisions.

After this ruling, transactional lawyers may want to change something about how they practice, said Blank Rome partner Susan Bickley of Houston, who isn’t connected to the case but has represented attorneys facing litigation.

“I think we are probably going to see an increase in recitations in transactions that you understand and the other party understands we have differing interests in this transaction,” she said. “I think there already is this sort of representation made in transactional documents, but I’m sure it will be increased, to stress that each party has their own interests in a transaction, and this is an adversarial context.”
