PANEL OVERVIEW

It’s often said that non-disclosure agreements (“NDAs”) have become the legal weapon of choice for the rich and powerful, used to silence the victims of sexual harassment or abuse by a person in power. Despite the bad press, NDAs are increasingly common in the context of divorce, pre-nuptial agreements, and the exchange of confidential information between private individuals. So, do NDAs still have a place and a purpose and when does a legal instrument, designed to help both parties, become a tool for the weak to be beaten by the strong? Our experienced panel will explore the types of NDAs individuals are being asked to sign; the ethical considerations for lawyers when drafting and advising clients on NDAs; and the public view on NDAs. This session is for lawyers advising on various areas of law, especially those advising clients in the public eye.
