ABOUT THE PROGRAM
Blank Rome and Anchin present a breakfast briefing that will feature an overview of the various repercussions of the CARES Act, which was passed in March 2020 as a measure to support businesses that were forced to shut down as a result of the COVID-19 pandemic. Specifically, this briefing will discuss the broader impact of the Paycheck Protection Program (“PPP”) and the Economic Injury Disaster Loan (“EIDL”) relief programs.
Presenters will evaluate the fraud schemes that emerged under these programs totaling over one trillion dollars that was loaned to more than 10 million small businesses and will include an interactive discussion on detecting and navigating PPP fraud cases prosecuted by the Department of Justice (“DOJ”), which are likely to proliferate in the near term.
Topics include:
- Evaluating eligibility, falsification of loan application documentation, use of stolen identities, and deliberate exploitation of the programs through conspiracy, sharing knowledge on how to circumvent controls, and obtaining kickbacks
- Analyzing fraud indicators such as: lack of wage data, inaccurate employee totals, improper payroll costs, multiple loans, reused information, and the use of different details for each program
- Trends towards increased enforcement
- Effective representation in PPP fraud cases commenced by the DOJ
