Marc Lerner

Biography

For four decades, Marc Lerner has helped his clients achieve their goals through either litigation or mediation. In addition to family law litigation, Marc has extensive civil trial experience in the areas of real estate, business, and contract matters. Previous to exclusively practicing family law, Marc garnered broad transactional experience in complex business matters. His multifaceted legal background makes him uniquely qualified to achieve creative and successful results for his clients in the face of challenging, complex financial and custodial cases.

Of late, Marc has expanded his mediation practice, motivated by his belief that clients are better served by resolving their issues instead of resorting to expensive and often frustrating litigation. A graduate of the Pepperdine Family Law Mediation Program, he is credentialed in both mediation and Collaborative Family Law, and has served for many years as a mediator for the Family Law Department of the Los Angeles Superior Court.

Experience

  • Richards v. Superior Court—In this case, the court found that Marc's client was entitled to disclosure of the defendants’ financial information relevant to punitive damages. The case established the balancing test between individual rights of privacy and the need for disclosure of personal financial information in civil cases.
  • Rossi v. Superior Court—In this case, Marc's client, Mr. Rossi, recovered 100 percent of his former wife’s lottery winnings ($16M) due to her breach of fiduciary duty in not disclosing her winnings to Mr. Rossi. The case was one of the earliest to interpret and apply the Family Code fiduciary disclosure requirements between spouses and the remedies for breaching a duty to disclose. The case received international media attention.
