Blank Rome Partner Stephanie Gantman Kaplan will be a panelist at the Philadelphia Bar Association live CLE webcast, Religious Freedom (to Discriminate?): The Intersection of Religious Freedom and LGBTQ Non-Discrimination Protections, taking place Wednesday, December 9, 2020, from 4:00 to 5:30 p.m. EST.

Following the United States Supreme Court’s decision in Bostock v. Clayton County holding that Title VI of the Civil Rights Act protects against discrimination based on sexual orientation and gender identity, while also referencing the possibility that religious freedom concerns may create the need for exceptions to anti-discrimination protections and the increasingly rightward shift of the Supreme Court following the confirmation of Justice Barrett, could a case arise that would argue that closely held religious beliefs may override those protections? Is religious freedom an exception that will swallow the rule, enshrining a “freedom to discriminate”?
