Risk Analysis: How Can We Even Begin to Negotiate, Mediate, or Commit to Arbitrate without Having First Analyzed Our Risks and Exposures?

ABA Dispute Resolution and Tort Trial & Insurance Practice Sections

Online Webinar

Blank Rome partner Deborah Greenspan will serve as a panelist for Risk Analysis: How Can We Even Begin to Negotiate, Mediate, or Commit to Arbitrate without Having First Analyzed Our Risks and Exposures?, the first in a two-part webinar series presented by the American Bar Association (“ABA”) Dispute Resolution Section and ABA Tort Trial & Insurance Practice Section’s (“TIPS”) Dispute Resolution Committee, on May 14, 2024, at 1:00 p.m. EDT.

ABOUT THE PROGRAM

Any decision concerning the resolution of a case involves risk assessment and case valuation. Attorneys not only need to analyze the law and the facts, but they need to understand their client’s risk tolerances and make recommendations based on an objective assessment of the risks. This is complicated in any case, but particularly so in multiparty cases involving significant damages. The decisions in mediation, arbitration, and litigation are all impacted by how each party has assessed its risks and exposures. This panel has vast experience in helping parties make such assessments.

Panelists:

  • Moderator: Steve Schulwolf, Schulwolf Mediation
  • W. Timothy McSwain, Founder / Aviation Safety & Insurance Consultant, McSwain Consulting
  • Deborah Greenspan, Partner, Blank Rome LLP
  • Timothy Raab, Managing Director, Alvarez & Marsal Disputes and Investigations

The second webinar in the series, Mastering Early Mediation: Strategies for Success, will take place on June 4, 2024, at 1:00 p.m.
