David A. Sudeck

CO-CHAIR, HOSPITALITY PRACTICE

David Sudeck’s practice primarily involves the complex issues associated with major commercial real estate projects, particularly those involving hotels, resorts, restaurants, and mixed-use hospitality projects.

David is a seasoned real estate attorney and dealmaker with an international reputation for his experience with projects with a hospitality component. He focuses in particular on providing practical counsel on critically important management and branding agreement issues. He is also widely recognized for providing top business and legal advice to hotel owners and lenders in the purchase, sale, development, construction, financing, leasing, and sale-leaseback of properties.

When he is not working on traditional senior debt or mezzanine financings for owners or lenders, David is likely working on creative joint ventures or “alternate” commercial property assessed clean energy (“C-PACE”) or EB-5 financings. Over the past few years alone, David and his team have closed more than $600 million of C-PACE financings, and $1.7 billion of EB-5 financings.

David serves on the Public Policy Committee of Invest in the USA (“IIUSA”), the EB-5 industry’s trade group for regional centers.

• Represented owners opposite brands in connection with brand management agreements for several luxury projects.
• Represented owners in connection with high profile hotel lobby and rooftop food and beverage management agreements.
• Represented buyers and sellers in the purchase and sale of dozens of hotels.
• Represented capital providers and property owners in connection with C-PACE financing for hotels and multifamily units totaling more than $600 million over the past two years.
