Biography
Walter Davis has almost 30 years of experience as an intellectual property professional focusing on patent law, including more than 20 years of private practice experience and six years of experience as a patent examiner at the U.S. Patent and Trademark Office (“PTO”).
Walter’s years of experience have enabled him to develop an uncommon and sought-after breadth and depth of experience. He is deeply experienced and skillful at litigation, petitions for inter partes review or post-grant review, and patent prosecution. The majority of Walter’s practice consists of patent, trade secret, and other intellectual property litigation, in U.S. district courts, the U.S. International Trade Commission, and the Court of Appeals for the Federal Circuit. Walter has first-chair experience as well as extensive experience managing the day-to-day operation of litigations and developing and implementing litigation strategies.
Representative technologies for Walter’s cases include microprocessors, smart home systems, software, Internet technology, smartphones, lighting control systems, consumer appliances, liquid crystal display devices, plasma display devices, semiconductor design and fabrication, medical imaging systems, battery chargers, computer hardware technology, telecommunications, and pharmaceuticals.
Outside the Firm
Walter enjoys golfing, traveling, smoking meat on his offset smoker (especially brisket), and spending time with his family. A native Washingtonian, Walter is an avid fan of Washington’s professional sports teams, particularly the football team.
Experience
- Represented an innovative company with a large patent portfolio against several large international companies in multiple patent infringement suits regarding patents directed to smart home technology in multiple district courts (including the Eastern District of Texas and the Eastern District of Virginia) and the U.S. International Trade Commission.
- Defended a multinational corporation against a non-practicing entity in patent infringement suits in multiple district courts regarding patents directed to network technology.
- Defended an Internet security corporation in a trade secret misappropriation suit in the Eastern District of Virginia.
- Defended a trade secret misappropriation claim of two billion dollars in the wireless lighting control industry.
- Represented a multinational integrated circuit manufacturer in its assertion of patents directed to microprocessor technology against a large multinational technology company at the U.S. International Trade Commission
- Represented a multinational consumer electronics company against a large multinational technology company in a patent infringement action involving power management aspects of smartphones.
- Represented a multinational consumer electronics company against a large multinational technology company in a patent infringement action involving various software-related aspects of smartphones, including, among other things, the user interface and real-time signal processing.

Walter has spoken often in the United States and abroad on a wide range of intellectual property topics. He has served as chair, vice-chair, and secretary of the Intellectual Property Section of the National Bar Association, the nation’s oldest and largest association of predominately African American lawyers and judges. As chair, Walter helped found the National Bar Association’s Diversity in Tech Awards, which recognize diverse lawyers and in-house legal departments that have demonstrated a commitment to advancing the hiring, retention, and promotion of diverse attorneys in the technology industry.
