Seth D. Lamden

Biography

For more than 20 years, Seth has focused his practice exclusively on helping policyholders understand and enforce their rights to insurance coverage. Through litigation and negotiation, Seth has helped policyholders recover hundreds of millions of dollars in insurance proceeds in connection with a broad array of claims and losses, including consumer class actions, professional liability claims, environmental claims, course-of-construction property damage and delay claims, construction defect claims, toxic tort claims, product liability claims, directors and officers liability claims, employment practices claims, ERISA fiduciary liability claims, property damage, cyber claims, and business interruption losses.   

In addition to his litigation practice, Seth offers strategic advice to his clients through all stages of the insurance life cycle, from policy negotiation and drafting contractual insurance requirements through counseling policyholders and claimants on how to maximize insurance recovery.

Seth is a frequent speaker on insurance coverage issues, and he has written dozens of articles and nine book chapters on topics relating to insurance recovery.

  • Representation of a utility company in coverage litigation arising out of a $177 million settlement with the State of Missouri for damages caused by the catastrophic failure of a hydroelectric dam. 
  • Representation of a utility company in first-party property insurance coverage matters arising out of the $500 million rebuild of a hydroelectric dam.
  • Representation of a general contractor in coverage litigation arising out of an underlying $30 million claim alleging negligent professional services in connection with the construction of a psychiatric hospital.
  • Representation of a mobile refrigeration unit manufacturer in coverage litigation arising out of an underlying nationwide consumer class action. 
  • Representation of an insulated drink and bottle manufacturer in coverage litigation arising out of an underlying nationwide consumer class action. 
  • Representation of a utility company in a $20 million builder’s risk and delay in start-up claim arising out of the construction of a 1,600-megawatt coal-fired power plant.
  • Representation of insurance broker in coverage litigation arising out of a $10 million underlying claim alleging fraud and negligence in connection with the creation and sale of a pooled captive insurance program.
  • Representation of a managed care company in coverage litigation against its E&O insurers arising out of underlying class actions involving alleged improper administration of PPO networks.
  • Representation of a bank in coverage litigation arising out of an underlying $10 million RICO lawsuit.

Professional Activities

Seth is a fellow of the American College of Coverage Counsel, an honorary organization of the country's top insurance coverage lawyers. He serves as the executive editor of Insurance Law Essentials, a publication of the International Risk Management Institute, and is the chair-elect of the Insurance Coverage Litigation Committee of the American Bar Association’s Tort, Trial & Insurance Practice Section.

Seth previously served as a board member of the Illinois Association of Defense Trial Counsel (2017–2020); chair of the Insurance Law Committee, Illinois Association of Defense Trial Counsel (2012–2013 and 2016–2018); co-chair of the D&O Committee, American College of Coverage Counsel (2019-2020); and chair of the Self-Insurance and Risk Management Committee, Tort Trial & Insurance Practice Section, American Bar Association (2017–2018).
