Derek E. Schultz

Biography

Derek assists clients with a range of labor and employment litigation matters before administrative agencies, state courts, and federal courts. His labor experience spans the entire unionization process, including union representation and decertification elections in multiple regions throughout the country, negotiating collective bargaining agreements, defending and prosecuting unfair labor practice charges, and assisting with grievance arbitrations and drafting post-arbitration briefs. Derek also prepares state court injunction papers and develops and implements employer-focused strike responses.

Derek handles the entire trial preparation and litigation process, from discovery document review through trial strategy, negotiation, and settlement. He engages in trial preparation, assists with preparing for and taking depositions, drafts responsive pleadings, engages in motion practice, drafts briefs, and negotiates and drafts settlements.

Prior to joining the firm, Derek served as an associate attorney in the labor and employment group at a full-service firm, and as an associate attorney in the litigation department of two other firms.

During law school, Derek served as a corporate legal intern and a law clerk at two full-service law firms, a summer associate at a natural gas supplier and distributor, and a judicial intern for the Erie County Court of Common Pleas.

Outside the Firm

Derek enjoys playing golf, skiing, being outdoors, and spending time with his family. 

Experience

  • Successfully represented a large hospital network in a decertification of a 200+ employee Unit.
  • Coordinated and successfully strategized to defeat numerous union organizing efforts for large hospital networks, hotel chains, casinos, transportation companies, cannabis employers, and construction companies.
  • Successfully navigated a three-week strike for a national transportation company.
  • Counseled a national entertainment company through a nine-month strike which ended in the Union disclaiming interest in the bargaining unit.
