Matrimonial and family law attorney Alan R. Feigenbaum, a partner at Blank Rome LLP, tells PEOPLE that there are a few things that might set an influencer's prenup apart from a traditional one. ...

While a traditional prenup deals in assets as we know them — tangible things like a house or something more standard like a 401(k), influencer prenups often deal in the intangible — much like their jobs on social media. One of the trickiest parts of developing a prenup as an influencer is defining those assets, which generally live in the form of content online,&nbsp;Feigenbaum tells&nbsp;PEOPLE. "If you can’t properly define what those assets are as a first step, then whatever your prenup provides as to how the asset is divided upon divorce could be meaningless,"&nbsp;Feigenbaum explains. Essentially, you must make absolutely clear what an "asset" includes when it comes to being an influencer. Is it a social media handle? A specific TikTok? The influencer's identity? Income from ads or merch sales? "A divorce lawyer drafting a prenup in this scenario should consult an [intellectual property] lawyer to be sure that the asset is defined as precisely as possible,"&nbsp;Feigenbaum advises.
