Our world remains volatile and uncertain, with political and economic crises on every continent. However, the cooperation and cross-border work that continues to emerge through the global restructuring profession, makes a material contribution to a more stable and predictable future for businesses and the people that depend on them. The work is often complex and challenging, but it is rewarding, it is important, and it makes a real difference in the world.

Deborah’s session, “How Much Is Too Much? Channeling Mass Tort Claims through an Insolvency Proceeding,” will take place on Friday, May 24, from 12:00 to 1:15 p.m.

For many years, companies in the United States have used Chapter 11 proceedings to resolve mass tort claims, including asbestos, opioid, and talc personal injury claims resulting in the creation of trusts to process and pay the claims and the imposition of injunctions that release the company and third parties from all liability with respect to the claims. More recently, U.S. companies have isolated their mass tort liability in a subsidiary and filed the subsidiary for bankruptcy to resolve claims. Companies in other jurisdictions have also used restructuring or insolvency proceedings to resolve mass tort claims.

This panel will explore challenges posed by mass tort claims, alternatives available in the United States and other jurisdictions for resolving these claims, use of insolvency proceedings to resolve mass tort liability, pros and cons of using an insolvency proceeding to resolve mass tort claims, and the outlook for future use of insolvency proceedings to resolve mass tort claims.
