Bid protests usually conjure images of the Government Accountability Office, which has long enjoyed unofficial status as the default bid protest forum, but that is starting to change. The Court of Federal Claims has increasingly become the preferred forum for many protesters. Although the two forums are similar in many respects, there are a number of unique aspects to litigating bid protests at the Court of Federal Claims that successful practitioners must know. This panel will discuss those unique aspects from the perspective of the key stakeholders: the bench, the bar, and the client.
