ABOUT THE PROGRAM

The panel will discuss cases that the United States Supreme Court will decide this term that will have a significant impact on the resolution of mass tort claims. The Supreme Court’s decision in Purdue Pharma may materially impact the landscape of third-party releases in mass tort cases and, correspondingly, impact the ability of companies to use their insurance assets to resolve mass tort claims.

Similarly, the Supreme Court’s ruling in Kaiser Gypsum will directly address the ability of insurers to impact the Chapter 11 process. In addition, the panel will review the decisions in LTL and Aero by the various Circuit Courts and discuss alternative resolution structures for mass tort claims.

Panelists:

  • Josh Weinberg (Ruggeri Parks Weinberg)
  • Matt Linder (White and Case)
  • Adrian Azer (Haynes Boone)
  • Deborah Greenspan (Blank Rome LLP)
