Blank Rome partner Jeffrey N. Rosenthal will serve as a speaker at the American Conference Institute’s (“ACI”) 11th Annual Legal, Regulatory, and Compliance Forum on Cosmetics & Personal Care Products, being held March 20 through 21, 2024, in New York, New York.

ABOUT THE CONFERENCE

The Modernization of Cosmetic Regulation Act of 2022 (“MoCRA”) on the federal level has expanded the Food and Drug Administration’s jurisdiction over the cosmetic industry. With MoCRA currently in its initial phases, businesses within the cosmetics industry should proactively anticipate and ready themselves for impending modifications.

States, particularly California, Washington, Maine, and Ohio, are actively driving further reforms and intensifying regulations on harmful chemicals and contaminants in cosmetic products and their packaging.

This year’s agenda features sessions on implementing MoCRA, safeguarding brands against class actions, navigating compliance with per-and polyfluoroalkyl substances (“PFAS”) and California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (“Prop65”), interpreting Federal Trade Commission guidance on endorsements, exploring environmental, social and governance (“ESG”) and sustainability in the beauty industry, and addressing challenges related to intellectual property, data privacy, and considerations of generative artificial intelligence (“AI”).

Jeffrey’s session, “AI and ML in the World of Cosmetics: Navigating Data Privacy Concerns While Embracing New Technologies,” will take place on Wednesday, March 20, from 10:30 to 11:15 a.m.

ABOUT THE SESSION

Emerging technologies such as AI and the metaverse are being increasingly utilized by beauty brands, however, these promising advancements are accompanied by various critical considerations and concerns—the paramount one being privacy. Session topics include:

  • Analyzing how the beauty industry is utilizing the metaverse and various digital technologies including AI, machine learning (“ML”), augmented reality (“AR”), and virtual reality (“VR”)
  • Reviewing state enforcement activity concerning the use of biometrics and its impact on the cosmetics industry such as the Illinois Biometric Information Privacy Act
  • Identifying privacy and ethics concerns with the use biometric data
  • Examining how personalized tools that incorporate artificial intelligence and biometric data (face scanning tools) can lead to privacy violations
  • Assessing privacy risks in AI-based personalized tools, including face scanning tech

Generative AI Focus:

  • Uncovering how generative AI is reshaping product innovation, from custom formulations to personalized beauty recommendations
  • Addressing the ethical concerns and privacy considerations that come with this technological advancement
