International Asset Tracing in Insolvency (2nd Edition)

Blank Rome of counsel Evan Jason Zucker authored a chapter in the book International Asset Tracing in Insolvency (2nd Edition), published by Oxford University Press. This international book, written by experienced practitioners, covers six jurisdictions: the United States, England and Wales, the British Virgin Islands, the Cayman Islands, Jersey, and Guernsey. 

Evan wrote the United States of America chapter, which provides a comprehensive overview of U.S. insolvency law, focusing on the key aspects of chapter 11 and chapter 15 bankruptcy proceedings as tools for tracing and recovering assets. Key mechanisms include: (1) the automatic stay, which halts creditor actions against the debtor’s estate; (2) avoidance actions that allow the recovery of improperly transferred assets; and (3) broad discovery rights to investigate the debtor’s financial affairs. Additionally, it includes a comparison of the U.S. insolvency law to foreign laws, highlighting the unique features and advantages of the US system. The chapter concludes with an overview of the evolving treatment of cryptocurrency in bankruptcy, including issues related to its valuation, transfer, and recovery.
