Intellectual Property Legal Opinions, Second Edition

Wolters Kluwer Law & Business recently released the 2017 Supplement to Intellectual Property Legal Opinions, Second Edition. Co-authored by Blank Rome Partners Mark Thronson and Jon Grossman, as well as Gabrielle S. Roth, partner in the trademark practice at Sughrue Mion in Washington, D.C., the leading treatise on IP counseling (832 pages) has been updated every year since 1999.

Topics covered include attorney-client and third party communications, patent infringement, right-to-use, and validity opinions, the patent opinion-of-counsel defense, trademark searches and investigations, trademark availability opinions, trademark dilution and Internet considerations, copyright opinions, responses to auditor inquiries, IP due diligence for business transactions, and related ethics/professional responsibility issues.

For each type of opinion, the authors present:

  • Background information that shows the necessity and utility of such an opinion
  • Essential elements of a competent opinion
  • Relevant statutory and case law authority controlling certain aspects of the opinion
  • Real-life examples whenever possible and suggested solutions in the many areas where the courts have not resolved problems
