Shannon E. McClure

Shannon is a partner in Blank Rome’s Business Litigation group with a national practice defending healthcare and life sciences companies in high-stakes disputes. She passionately advocates for national and multinational companies in complex civil litigation, and as a first-chair trial attorney, she deftly manages business disputes in federal and state courts, as well as in arbitration and mediation. Shannon also plays a pivotal role in devising global resolution strategies in multijurisdictional litigation, acting as coordinating counsel for clients in high-stakes cases. Shannon has built an active practice defending companies navigating the fast-moving legal landscape surrounding GLP-1 and peptide medications. She defends health platforms, compounding pharmacies, and clinics in novel federal lawsuits alleging Lanham Act unfair competition claims and related state law causes of action arising out of GLP-1 products, including compounded semaglutide and tirzepatide. She also defends platforms and pharmacies facing consumer protection class actions arising from compounded GLP-1 use.

Shannon has served as national trial counsel for a global healthcare company in high-profile opioid litigation, organizing and overseeing a nationwide defense to thousands of state and federal court lawsuits brought by states, counties, municipalities, hospitals/health systems, third-party payors, and individual claimants. Drawing on her multi-district litigation (“MDL”) and mass torts leadership experience, she was appointed MDL defense co-liaison counsel in In re Prescription Opiate Litigation (MDL-2804, N.D. Ohio). She tried and won a complete defense verdict in the first pharmaceutical distributor opioid case to go to verdict – a four-month, 70-witness bench trial – City of Huntington et al. v. AmerisourceBergen et al., 2022 U.S. Dist. LEXIS 117322 (S.D.W. Va. July 4, 2022). Shannon also served on the distributor’s resolution settlement team that negotiated distributors’ $21 billion global opioid settlement with the State Attorneys General, as well as other associated settlements, and directed underlying case litigation strategy.

Shannon excels as lead coordinating counsel for multijurisdictional litigation, class actions, and other large-scale complex legal matters. She has nearly 25 years of litigation experience in breach of contract and business tort cases, antitrust matters, and public nuisance cases. Additionally, Shannon advises companies on pre-dispute counseling, conducting thorough case assessments to evaluate the merits of potential litigation stemming from commercial disputes, and proceeding with filing and litigating the case if necessary, including seeking temporary restraining orders and preliminary injunctions. She is also experienced in arbitrations and mediations, and has appeared before many of the country’s leading mediators. Shannon has experience working in untested, cutting-edge litigation spaces, including the emerging GLP-1 landscape, where there is often no “playbook” for how the litigation “should” proceed; she is comfortable creating her own.

Shannon’s primary industry focus is healthcare and life sciences. In those industries, Shannon represents pharmaceutical and medical device manufacturers, distributors, platforms, pharmacies, health systems, and clinics, with particular depth defending companies in the GLP-1 and peptides space, including telehealth platforms and compounding pharmacies facing Lanham Act and unfair competition claims. In addition, Shannon represents companies operating in the energy, financial services, real estate, transportation and logistics, gaming, retail, infrastructure, testing, and telecommunications industries with complex disputes.

Outside of her practice, Shannon served as Chair of the Eastern District of Pennsylvania’s Merit Selection Panel, responsible for overseeing the process to recommend candidates to be considered to serve as United States Magistrate Judges. Her legal career also includes a clerkship with the Honorable Timothy J. Savage at the U.S. District Court – Eastern District of Pennsylvania (September 2003 to September 2005).

During law school, Shannon distinguished herself as Executive Editor of the William and Mary Law Review, a member of the William and Mary Journal of Women and the Law, and a Moot Court Team Member. She received a merit scholarship and the Gambrell Professionalism Award. In college, Shannon majored in History and Theater, was a member of the Phi Alpha Theta History Honor Society, consistently made the Dean’s List, and participated in the Kappa Kappa Gamma sorority and a study abroad program in London.
