Richard M. Weibley

Biography

Richard Weibley focuses his practice on complex commercial litigation, defending Fortune 500, Fortune Global 500, and other corporations in contract and business disputes, intellectual property matters, employment matters, and product liability matters.

Richard represents clients in state and federal trial courts across the country, domestic and international arbitrations, and state and federal appellate courts. In addition to performing all aspects of civil litigation, he also provides counseling to clients to avoid or best position potential litigation.

During law school, he served on the Washington and Lee Law Review.

Experience

  • Successfully prosecuting and defending tortious interference claims, including conducting a two-week federal jury trial resulting in the successful settlement of multiple litigations relating to industrial supply contracts.
  • Litigation relating to the ownership of oil, gas, and mineral rights, including winning a jury verdict declaring termination of an oil and gas lease.
  • Cases involving corporate governance and breach of fiduciary duty, including winning a jury verdict after an eight-week trial in California state court relating to mortgage-backed investments and successful litigation in Delaware Chancery Court over the dissolution of a closely held Delaware corporation.
  • Representation of various companies in litigation over employees’ restrictive covenants and claims of unfair competition and theft of trade secrets.
  • Obtained summary judgment defeating multimillion dollar claims for promissory estoppel against a fast food franchisor.
  • Secured a dismissal of claims for computer trespassing and conversion against a company specializing in peer-to-peer network intelligence services.
  • Various international arbitrations, including a Stockholm arbitration relating to the breach of a multibillion dollar uranium supply agreement, and a London arbitration relating to the termination of a manufacturing company’s joint venture in India.
  • Vindicated a gas supply company’s form supply agreement from a customer’s competing interpretation and claims of unconscionability.
  • Representation of various manufacturers of building products and consumer goods against claims for breach of warranty and products liability.
  • Patent infringement cases relating to a variety of technologies, including water treatment processes, gas-to-liquids technology, and chemical milling equipment.
  • Successfully defended the creators of a video-sharing website against breach of contract claims and competing claims of ownership.
  • Successfully defended a bank against lender liability and bad faith claims.
