Biography
Malcolm M. Bates concentrates his practice on finance, restructuring, and bankruptcy matters, drawing on significant experience representing clients in complex Chapter 11 cases and related litigation. Malcolm most recently served as a trial attorney in the United States Department of Justice’s Office of the United States Trustee. In that role, he represented the U.S. Trustee in a wide range of bankruptcy proceedings and contested matters in the District of Delaware, from “first-day” relief through plan confirmation proceedings. He later served as a regional appellate coordinator, advising U.S. Trustee Program leadership and managing appeals across the Third Circuit.
Malcolm also has experience representing creditors, debtors, trustees, and other stakeholders in and out of bankruptcy court. His work includes litigation, appeals, and counseling financial institutions and investors on bankruptcy alternatives, commercial disputes, and out-of-court restructurings.
Malcolm maintains an active pro bono practice, including representing asylum seekers, counseling nonprofits on policy matters, and participating in consumer bankruptcy initiatives.
While in law school, he served as a senior editor for the Georgetown Journal of International Law and as a judicial intern for the Honorable Petrese B. Tucker at the United States District Court for the Eastern District of Pennsylvania.
Outside the Firm
Malcolm enjoys spending time with his family, running, and taking on new challenges in the kitchen.
