Jillian M. Taylor

Biography

Jillian Taylor concentrates her practice on a variety of intellectual property and technology law matters, assisting her clients in maximizing their intellectual property, technology, and other intangible assets. She has experience serving a broad range of clients, from publicly traded and private companies to entrepreneurs, start-ups, and other emerging businesses.

Jillian counsels clients on matters relating to:

  • Comprehensive U.S. and international intellectual property portfolio management.
  • Strategic counseling on brand creation, clearance, and enforcement issues.
  • Preparing and negotiating a broad range of software, technology, copyright, patent, trademark, and other intellectual property licenses and agreements, including joint venture, confidentiality, and technology transfer agreements.
  • Advising and conducting due diligence related to the acquisition and sale of public and private companies with respect to their intellectual property and intangible assets.
  • Intellectual property litigation in state and federal jurisdictions and before the Trademark Trial and Appeal Board of the U.S. Patent & Trademark Office.
  • Strategic advising on the Digital Millennium Copyright Act (“DMCA”) and related anti-circumvention and infringement provisions of the U.S. Copyright Act.
  • Counseling in Internet law, domain name disputes (“UDRP”), and digital asset protection.

Prior to joining Blank Rome, Jillian was an associate for an international law firm. She also previously served as a law clerk for the Honorable Cynthia M. Rufe as well as the Honorable Joel H. Slomsky of the U.S. District Court for the Eastern District of Pennsylvania.

Experience

IP Counseling:

  • Advised an international gaming company on best practices for policing infringement in non-fungible tokens (“NFTs”) and other digital assets.
  • Advised an international skincare company on licensing issues with a subsidiary’s proposed marketing of a new trade dress, packaging, and labeling for a house brand.
  • Advised a Fortune 500 company on its risk exposure for its use of information collected from social media platforms.
  • Advised a national educational association on copyright infringement and publicity right matters associated with presentations given at its conferences.
  • Advised an international recruiting agency on its risk exposure for collection of data using a third party web scraper.

IP Transactions:

  • Represented several private equity clients in the purchase and sale of portfolio companies having multinational IP assets and ongoing IP litigations.
  • Represented a national gaming company in the drafting and negotiation of joint development and licensing agreements.
  • Represented an emerging technology company in creating policies, rules, FAQs, and other user documentation for its website.

IP Litigation:

  • Represented an international clothing retailer in trademark infringement and unfair competition litigation in the United States District Court for the Southern District of New York, including obtaining a favorable summary judgment ruling.
  • Represented many recording artists in class actions raised against major record labels alleging copyright infringement in the United States District Court for the Southern District of New York.
  • Represented a national home décor company in copyright infringement litigation in the United States District Court for the Southern District of New York.

Professional Activities

Jillian maintains an active pro bono practice, which includes advising clients of their right to clear their criminal records under Pennsylvania’s Clean Slate Law, the first of its kind in the United States.

Jillian is a member of the board of directors of the Da Vinci Art Alliance, a non-profit organization based in South Philadelphia that builds community through art, fosters artists, and provides free exhibitions and programming for the community.
