Jamison T. Gilmore

Biography

Jamison Gilmore represents clients in complex commercial disputes from pre-litigation through trial and arbitration. He is experienced in handling matters involving trade secret misappropriation, breach of contract, copyright infringement, and unfair business practices (section 17200). Jamison represents both plaintiffs and defendants in a variety of industries, including media and entertainment, technology, healthcare, energy, and construction industries in arbitration and litigation. He handles all aspects of disputes, including the preparation of pleadings, propounding of and responding to discovery, drafting of dispositive motions, taking and defending depositions, and preparing for and attending trial and arbitration. 

Before Blank Rome, Jamison externed for U.S. Magistrate Judge Michael Wilner (ret.) and clerked for Los Angeles Superior Court Judges Christopher Lui, Theresa Traber, and Daniel Crowley.

Dispositive Motion Practice

Jamison regularly obtains favorable results through a robust dispositive motion practice. He prepared over 3,000 tentative orders while clerking at Los Angeles Superior Court—none of which were reversed on appeal. Using this unique experience in practice, Jamison has consistently and successfully prepared and defended against motions to dismiss, demurrers, motions to strike, motions to quash service of summons, anti-strategic lawsuits against public participation (“SLAPP”) motions, and motions for summary judgment and summary adjudication.

Trial and Arbitration

Jamison has prevailed at each trial and arbitration he has handled. As a result of trial and arbitration, Jamison has secured permanent injunctions, judgments affirming trade secret misappropriation and breach of contract awards, and a six-figure award of attorney fees. Jamison’s results demonstrate his aptitude in handling tasks that arise in trial and arbitration, including preparing motions in limine, deposition designations and objections, demonstratives, witnesses, and pre- and post- trial and arbitration briefs.

Experience

Unfair Business Practices - Represented a pharmaceutical company in securing a permanent injunction under five states' unfair business practices statutes after a four-day Zoom bench trial against a competitor for selling a drug that was essentially a copy of the client's drug.

Breach of Contract - Represented one of the nation’s largest health systems in an action seeking indemnification from an interventional cardiologist whose submission of false claims to the U.S. government resulted in millions of dollars of liability under False Claims Act, Stark Law, and the Anti-Kickback Statute.

Trade Secret Misappropriation and Breach of Contract - Succeeded on merits in trade secret arbitration and subsequent award of six-figures in attorneys' fees.

Copyright Infringement - Obtained a dismissal of copyright infringement claims against a publicly-traded media client.

Anti-SLAPP - Obtained an order granting a client's anti-SLAPP motion striking portions of the plaintiff's complaint based on protected speech from the client's employees and counsel. Also obtained a related award of attorneys' fees for successfully moving to strike portions of the complaint.

Employment - Secured complete dismissal of sexual harassment claims on eve of arbitration.

Healthcare - Secured complete dismissal of California Health & Safety Code violations on behalf of one of the nation’s largest health systems.

Products Liability - Secured summary judgment for a major drug manufacturer against allegations that it failed to warn of harm caused by its second generation anti-psychotic medication.

Products Liability - Secured an order stating the court lacked personal jurisdiction for one of the largest oil manufacturers in the world in a wrongful death, negligent hiring, and public nuisance lawsuit involving an accident that occurred in a state outside of where the relevant petroleum-based product was manufactured.
