Biography
James G. Gorman III concentrates his practice on commercial, corporate, and intellectual property litigation.
Utilizing a unique combination of technical background and legal experience, James has been recognized for his success representing clients in a variety of fields, including biotechnology, medical devices, pharmaceuticals, semiconductor technology, software, gaming, and big data.
James has significant experience representing clients in the U.S. District Court for the District of Delaware, Delaware Court of Chancery, Delaware Superior Court, the Commonwealth Court of Pennsylvania, and the U.S. District Court for the Eastern District of Pennsylvania.
He routinely serves as both lead and Delaware counsel for clients litigating the following matters:
- Breach of contract
- Patent infringement
- Trademark infringement
- Trade secret misappropriation
- Business torts
- Breach of fiduciary duty and corporate governance claims
- Shareholder/stockholder disputes
- Regulatory disputes
James is skilled in all aspects of litigation, ranging from pre-litigation counseling to the courtroom, and he routinely leverages his experience at both the trial and appellate level to advise his clients in a cost-effective manner.
Previously, James served as a judicial extern for Judge Sue L. Robinson at the U.S. District Court for the District of Delaware. During law school, James served as a comments editor for the Penn State Law Review.
Outside the Firm
James has a passion for entrepreneurship and has previously advised young entrepreneurs at Penn State Law’s Entrepreneur Assistance Clinic. In his downtime, James enjoys spending time with family and friends and rooting for Philadelphia sports teams. James is also an avid skier and snowboarder.
Experience
- Obtained summary judgment award for a pharmaceutical company in a Delaware breach of contract, misappropriation of proprietary information, and fraudulent conveyance action. Revived an LLC that was improperly dissolved in an effort to dodge liability to the client. Thereafter, achieved favorable settlement.
- Successfully defended a semiconductor and sensor manufacturing conglomerate in a series of patent infringement actions in Texas. Claims were dismissed with prejudice.
- Secured significant settlement for a gaming company in a trademark infringement and unfair competition action in Pennsylvania. Successfully located the bad actor behind a series of shadow entities improperly trading on client’s name and shut down those entities and their marketing efforts.
- Obtained TRO and subsequent high-value settlement for a regenerative medicine biotechnology company in a Texas misappropriation of trade secrets and breach of contract action focused on conversion of assets by former owners after a company sale.
- On behalf of a medical and rescue equipment company, favorably settled a Delaware breach of contract and specific performance action, which was focused on a put option dispute in connection with an entity’s corporate documents.
- Favorably settled a Delaware action alleging a breach of stock purchase agreement on behalf of a data analytics company after executing an aggressive discovery campaign.
- On behalf of a major airline, defeated claims involving a fraudulent ticket scheme. Claims were dismissed in their entirety after rounds of motion practice.
