Daniel S. Klein

Biography

Daniel (“Dan”) Klein represents business and financial services clients in high-stakes commercial disputes, as both plaintiffs and defendants. As plaintiff’s counsel, he has secured seven-and eight-figure settlements and verdicts, including recently obtaining a $16.5 million jury verdict in federal court—a result recognized among the Top 100 jury verdicts in Texas for 2024. As defense counsel, he has secured dismissals, summary judgments, and trial verdicts for clients.

Dan has represented clients in a diverse range of industries, including energy, franchise, healthcare, aerospace, and real estate. He has extensive experience representing financial services companies—including top ten U.S. banks—in litigation and in distressed loan workouts and modifications.

Before practicing law, Dan served as a sergeant in military intelligence in the Marine Corps Reserves, deploying to Iraq and Afghanistan. Following his service, clerked for the U.S. Court of Appeals for the Eleventh Circuit. He has also practiced at an international litigation firm, a mid-sized full-service firm, and a boutique litigation firm.

  • A Medicare fraud qui tam case to jury verdict, obtaining $16.5 million in damages and penalties (before attorneys’ fee award). Listed in Top 100 jury verdicts in Texas for 2024.
  • A $5.3 million judgment on behalf of defrauded oil and gas investor in multi-forum litigation.
  • 35+ franchisees in mass arbitration against franchisor, resulting in confidential settlement.   
  • A $57 million judgment on behalf of oil and gas investors against foreign operator on claims arising from the purchase, lease, and use of drilling equipment.
  • An accounting malpractice arbitration for super-regional bank plaintiff resulting in confidential settlement before discovery began.
  • A regional lender in securing $10 million judgment against debtor and guarantor.
  • A former executive in claims related to company’s stock issuance and secured favorable pre-trial settlement. 
  • An international transfer agent in several Texas and Louisiana-based lawsuits, obtaining dismissals or early favorable settlements of claims.
  • Secured summary judgment, ending supplier’s claims against investor who had acquired business.
  • An investor in asserting fraud claims and obtained favorable decision from Texas Fifth Court of Appeals affirming jurisdiction over defendant.   
  • A receiver of global consumer electronics brand in proceedings related to the brand’s eventual bankruptcy reorganization.  
  • A top-10 U.S. bank in lawsuit against factoring company over its purchase of bank’s collateral; defeated factoring company’s motion to dismiss and case settled shortly thereafter.
  • Won Rule 12(b)(6) dismissal with prejudice for a top-10 U.S. bank, dismissing counterclaims that alleged violations of the Anti-Tying Act, securities laws, and usury laws, among others, then negotiated favorable settlement.
  • Successfully compelled arbitration on behalf of top-10 U.S. bank in claims based on alleged misconduct by bank employee, then secured complete defense trial verdict.
  • Won offensive summary judgment for a top-10 U.S. bank in large complex commercial debt matter.
  • Obtained multimillion-dollar settlements for super-regional bank in multiparty litigation against borrower, law firm, and accounting firm.  
  • A fuel marketer in claims against biofuel supplier. Court denied supplier’s motion to dismiss and stayed case pending criminal investigation of supplier.  
  • Defense of multi-forum litigation for international client over disputed acquisition, concluding in favorable post-trial settlement.  
  • A Fortune 500 client in billion-dollar antitrust case, which successfully settled mid-trial.
  • An investment bank’s estate in 10+ litigations and mediations over disputed derivative transactions. Estate recovered over $1 billion from its counterparties.
  • A Dallas-based technology company in securities class action, defeating plaintiff’s request to enjoin transaction.
