Matrimonial and family law attorney Alan R. Feigenbaum, a partner at Blank Rome LLP, tells PEOPLE that there are a few things that might set an influencer's prenup apart from a traditional one.
...
While a traditional prenup deals in assets as we know them — tangible things like a house or something more standard like a 401(k), influencer prenups often deal in the intangible — much like their jobs on social media.
One of the trickiest parts of developing a prenup as an influencer is defining those assets, which generally live in the form of content online, Feigenbaum tells PEOPLE.
"If you can’t properly define what those assets are as a first step, then whatever your prenup provides as to how the asset is divided upon divorce could be meaningless," Feigenbaum explains.
Essentially, you must make absolutely clear what an "asset" includes when it comes to being an influencer. Is it a social media handle? A specific TikTok? The influencer's identity? Income from ads or merch sales?
"A divorce lawyer drafting a prenup in this scenario should consult an [intellectual property] lawyer to be sure that the asset is defined as precisely as possible," Feigenbaum advises.
