The divorce was striking, said Morgan Mouchette, partner and vicechair of the Matrimonial and Family Law Practice at law firm Blank Rome, because it represented “one of the largest divisions of assets by a couple, and the terms relating to their charitable giving and respective foundations represent a significant portion of the wealth being transferred as a result of the divorce.”

Typically, in addressing a foundation as part of a divorce, the foundation is essentially split, said Kyle Durante, a partner in Blank Rome’s Trust and Estate Practice. One spouse maintains control over the existing foundation, while the other spouse establishes their own foundation, with assets being distributed from the existing foundation to the new foundation. That’s not what happened here. “In this divorce,” Durante said, “Melinda established a new foundation, Pivotal Philanthropies Foundation, and Bill agreed to individually contribute approximately $7.8 billion to it.”
