In the wake of Margaret Qualley and Jack Antonoff‘s split just shy of their three-year anniversary, the couple would have to divvy up their assets should they proceed with a divorce.

“The focus of divorce is what you created during the marriage, and they both were active, him in his producing career, her in her acting career, during the marriage,” says Brett Ward, a partner and co-chair of the Litigation department at Blank Rome; he is not connected to the case.

“It comes down to this is a less than three-year, childless marriage. Most courts are going to look at it as more of a walkaway situation,” he adds.

In fact, should Qualley and Antonoff have a prenuptial agreement as Ward suspects they might, the terms might also simply support the “walkaway” idea: “mine is mine, yours is yours,” he says, given that “both people are financially independent and had a large amount of success coming into the marriage.”

A separate source confirms to PEOPLE that Antonoff and Qualley indeed entered their marriage with a prenup. Reps for Antonoff and Qualley have not responded to PEOPLE’s request for comment.

“There won’t be much of a difference between a prenup that says everybody keeps their own and what a court would do when you have a less than three-year marriage with no children,” he says, emphasizing that the shorter duration of Qualley and Antonoff’s union is a big factor from a legal standpoint.
