At first blush, hospital price transparency regulations seem like a good fit for President Donald Trump’s deregulatory mission and could fall within his April 9 presidential memo ordering federal agencies to identify regulations that are “unlawful” and “begin plans to repeal them.”

In the presidential memo, “Directing the Repeal of Unlawful Regulations,” Trump instructs the heads of federal agencies and departments to identify regulations for repeal within 60 days. The memo “puts more meat on the bones” of the Feb. 19 executive order implementing the Department of Government Efficiency deregulatory initiative, said attorney Christina McKinley, with Blank Rome.

The administration may be pushing the envelope with the good cause exception, attorneys say.&nbsp;

There’s ambiguity with respect to the good cause exception, McKinley noted. “It invites a lot of uncertainty both on the procedural piece and the merits piece.” There’s the question of whether the good cause exception would be applicable to a rescission—in other words, whether agencies can use the good cause exception to repeal a regulation and whether a regulation is, in fact, inconsistent with Supreme Court precedent, McKinley said. “For example, under Loper Bright, whether a regulation reflects the ‘single, best meaning’ of the statute authorizing it is a question that may not be facially obvious,” McKinley noted. More litigation is probably on the horizon.
