About the Session

Reinsurance provisions can make—or break—the effectiveness of a captive insurance program. Poorly drafted or misunderstood clauses often lead to disputes, coverage gaps, and unintended financial exposure. This panel will explore how to identify, negotiate, and avoid problematic reinsurance provisions before they become costly issues. ‍Attendees will gain a clearer understanding of common pitfalls in reinsurance agreements, including ambiguous wording, misaligned risk transfer expectations, and dispute-triggering clauses. The session will also examine real-world examples of how these issues have played out in practice, offering actionable guidance on structuring agreements that stand up to scrutiny.
