Attorneys know they need to prepare fully for mediation in order to be successful. But how you prepare for the mediation and present your case to the mediator may differ depending on the stage of the case—whether pre-litigation, before the filing of a summary judgment motion, after a motion for summary judgment motion is filed but not yet heard, post summary judgment denial, or on the doorstep of trial—where you’ll need to consider what to share and what to hold back. Experienced mediators and employment litigation trial attorneys (plaintiff and defense) will discuss the most successful ways to present a case at mediation.
