Blank Rome partners Jennifer L. Achilles and Linda Imes will serve as speakers for Company Counsel Sharing Investigation Findings with DOJ to Maximize Cooperation Credit and Minimize Risk of Waiving Privilege, a myLawCLE program being held Thursday, November 19, 2026, from 12:00 to 2:10 p.m. EST, as a live video broadcast.
About the Program
The Department of Justice’s (“DOJ”) March 2026 Corporate Enforcement Policy ties cooperation credit to attributing facts to specific sources, and every attribution risks waiver. It is important to draft interview memos that protect work product, disclose findings without a witness-by-witness download, and defend the follow-on motion to compel.
Jennifer and Linda will present a working framework for separating facts from communications and fact from opinion work product under Upjohn v. United States and Hickman v. Taylor. They will also share do’s and don’ts for drafting interview memos and a strategy for meeting the attribution demand while maintaining privilege, along with best practices for opposing the waiver motion that follows.
Presenters:
