Mass Tort Bankruptcy Cases—Evolving Case Law Affecting Resolution and Insurer Participation Friday, February 21 8:45–9:45 a.m.

Mass tort bankruptcy cases present a multitude of complex issues, including third-party releases and divisive mergers. Often, insurance assets are fundamental to the ultimate plan of reorganization. The evolving case law affects the playing field and the resolution options available to parties in these cases. In many, if not most, situations, the parties turn to mediators to perform a variety of functions in an effort to achieve a resolution. This panel will discuss the current state of the law with a focus on the Supreme Court’s decisions in Harrington v. Purdue Pharma LP and Truck Insurance Exchange v. Kaiser Gypsum, which respectively addressed third-party releases and an insurer’s rights as a party in interest in the bankruptcy proceedings, as well as the use of mediation to address these complex issues.
