Blank Rome partner Charles S. Marion will serve as a panelist at the American Bar Association’s (“ABA”) 48th Annual Forum on Franchising, being held October 15 through 17, 2025, in Orlando, Florida.
Chuck’s session, “Trends in Injunctive Relief: A Survey of Recent Cases,” will take place on Thursday, October 16, from 10:30 to 11:45 a.m., and Friday, October 17, from 1:30 to 2:45 p.m.
ABOUT THE SESSION
Recent decisions show that courts in the United States have been increasingly hesitant to award injunctive relief to franchisors to enforce terminations of franchise relationships and post-term obligations, such as covenants against competition. Also, in January 2025, the North American Securities Administrators Association released guidance on the enforceability of noncompetition covenants that, if followed, may make it harder to obtain injunctive relief for violations of a noncompete. This workshop session will explore trends in the treatment of injunctive relief, including enforcing intellectual property rights and non-competition provisions. Panelists will address best practices for both franchisee and franchisor counsel when seeking or opposing injunctive relief.
