ABOUT THE SESSION
This session explores the impact of state-level initiatives that arise when FDA exercises enforcement discretion. Topics include recent state laws on PFAS in packaging, Extended Producer Responsibility (EPR) and composability labeling mandates, and expanded state enforcement on greenwashing, ingredient disclosures, and nicotine sales—including proposed vape bans and retail restrictions. The discussion will also address key Section 310(a) preemption rulings on state efforts to enforce FDCA provisions via consumer protection or false advertising laws.
