Bodner will serve as panelist at the American Bar Association (“ABA”) Section of Public Contract Law Bid Protest Committee’s “Outside the Record” Issues program, taking place Tuesday, November 18, 2025, from 12:00 to 1:30 p.m. EST. An option to attend virtually is available. David serves as vice chair of the Committee.
ABOUT THE PROGRAM
The panelists will provide their perspectives on using “outside the record” materials throughout the bid protest process at the U.S. Government Accountability Office (“GAO”) and the U.S. Court of Federal Claims, including: using government databases and public sources to support protest grounds, identifying the circumstances under which supplementation of the administrative record is appropriate, and employing extra-record materials for injunctive relief and prejudice.

ABOUT THE PUBLIC CONTRACT LAW BID PROTEST COMMITTEE
The Bid Protest Committee provides timely information on developments and a forum for discussing significant issues involving the resolution of bid protests within the federal government, including the agencies, the Government Accountability Office, and judicial forums. It conducts ongoing studies on the efficacy of the system for resolving bid protest of federal agency procurements.
