Mark’s session, “New Wine in Old Bottles: Current Controversies under the Interstate Commerce Act,” will take place from 1:45 to 2:45 p.m. and the panel will discuss some of the current issues regarding the Federal Energy Regulatory Commission’s (“FERC”) regulation of interstate oil pipelines including the recent Magellan order, which prohibits certain marketing affiliate transactions, the current state of play for market based rates, and the upcoming index adjustment. The panel will also discuss the key differences between oil and gas pipeline regulation, including traps for the unwary.
