ABOUT THE PROGRAM
The Bureau of Industry and Security (“BIS”) has introduced the long-anticipated “Affiliates Rule,” significantly reshaping the landscape of export control compliance—especially for companies with exposure to China-related transactions. This rule extends Entity List, Military End-User List, and Specially Designated Nationals and Blocked Persons List restrictions to unlisted foreign entities owned 50 percent or more by listed parties, echoing the Office of Foreign Assets Control’s “50 Percent Rule” but with added complexity.
Anthony and Rachel will explore how the new rule affects exporters, financial institutions, and freight forwarders, including the new affirmative due diligence obligations, the “most restrictive” ownership mechanism, and practical strategies for compliance.
