Insurance Coverage Issues in the Opioid Litigation

Blank Rome Partner James R. Murray, chair of the Firm’s insurance recovery practice group, will speak at Perrin Conferences’ Opioid Litigation Conference, being held on Thursday, June 28, 2018, from 8:30 a.m. to 5:30 p.m. in Dallas, TX.

Jim’s panel, “Insurance Coverage Issues in the Opioid Litigation,” will take place from 2:15 to 3:15 p.m. and will cover:

• Current and former insurance coverage litigation regarding coverage for opioid lawsuits
• Distinctions in the underlying lawsuits, which may provide basis to categorize the lawsuits as potentially covered, or not covered, for coverage purposes
• Whether the lawsuits seek damages for “bodily injury” caused by an “occurrence,” as set forth in most commercial general liability policies
• Whether the lawsuits seek “damages,” based on the definition of “damages” in various insurance policy forms
• The application of various exclusions, including intentional acts exclusions, products exclusions, drug and pharmaceutical exclusions, and known loss
• The application of related claim, batch, or integrated occurrence language in various policy forms
