Blank Rome Partners Natasha Romagnoli and Seth D. Lamden will serve on panels at the American Bar Association (“ABA”) Tort Trial and Insurance Practice Section’s Hot Topics in the World of Insurance CLE program, which will be held April 13 and 14, 2021. 

Natasha’s session, “Emerging Issues in D&O Coverage,” will take place on Wednesday, April 14, at 12:00 noon, and the panel will discuss emerging and changing issues in Directors & Officers (“D&O”) Liability Coverage, including discussion of the 9th Circuit’s recent decision that excess insurers generally may not avoid or reduce their own liability by contesting payments made by underlying insurers, unless the payments were motivated by fraud or bad faith. They will also cover recent decisions applying Interrelated Wrongful Acts, the “bump up” exclusion, and the “dual capacity” exclusion, as well as the recent spate of lawsuits brought against companies and their directors and officers arising from the COVID-19 pandemic.

Seth will moderate the “Intersection of Insurance and Bankruptcy Law” panel immediately following Natasha’s panel on April 14. This session will discuss many of the complex insurance issues that can arise in bankruptcy proceedings, such as the resolution of mass tort claims with trusts and channeling injunctions, access to D&O insurance proceeds, satisfaction of self-insured retentions, and bankruptcy stakeholders’ objections to policy buyback or coverage-in-place agreements as part of a chapter 11 plan of reorganization.
