ABOUT THE PROGRAM
Understanding the changing landscape and its complications and implications is nothing short of critical—particularly for companies engaged in business across state lines.
This program is designed to provide a broad-based, foundational introduction to the core concepts of restrictive covenant law, including understanding the different types of restrictive covenants that are generally enforceable but sometimes not enforceable, the interests they can protect, the rules for their use, and basic drafting and litigating techniques.
Leigh Ann’s session, “The Basics of Restrictive Covenant Litigation,” will take place from 4:00 to 5:00 p.m., closing out the program.

This panel will cover essential components and effective strategies for litigating restrictive covenant cases, including:
- Key issues and common challenges that often arise in restrictive covenant litigation
- How to approach and handle a case from the perspective of a plaintiff and defendant
- Strategic use of forum selection and choice of law clauses, including their limitations
- Methods to maximize the likelihood of successful enforcement of restrictive covenants
- How a carefully crafted preliminary injunction order can protect a company and/or client’s interests, and avoid the need for protracted litigation
