Blank Rome Represents Christie's Fine Art Storage Services in Flood Insurance Claims

A Blank Rome litigation team secured an outstanding result for Christie’s Fine Art Storage Services in defending three large claims, exceeding $15,000,000, for damage to various collections of artwork.

Damage to the collections resulted when Christie’s Brooklyn warehouse flooded during Hurricane Sandy. All three complaints were dismissed when the court ruled that all three claimants waived their insurer’s right of subrogation. The court held that the waiver provision contained in the storage contract was valid despite U.C.C §7-204(2) forbidding limitation of liability clauses that completely exculpate a warehouseman’s liability.
