The Final Rule - titled Modifications to the HIPAA Privacy, Security, Enforcement, and Breach Notification Rules under the Health Information Technology for Economic and Clinical Health Act and the Genetic Information Nondiscrimination Act; Other Modifications to the HIPAA Rules - includes several provisions that impact research activities, most of which are consistent with the proposed rule published on July 14, 2010. And, while in many ways the Final Rule makes things harder for Covered Entities and Business Associates, research involving the use of Protected Health Information just got a little easier.]]></description>

		<description><![CDATA[If you are an insurer or attorney involved in making payment to a Medicare beneficiary or potential Medicare beneficiary on an aviation personal injury claim, you should be aware of the new reporting requirements under the Medicare and Medicaid State Children&amp;rsquo;s Health Insurance Program Extension Act (the &amp;ldquo;Act&amp;rdquo;), which are scheduled to go into effect April 1, 2011. A great deal of confusion and uncertainty exists as to the entire process, including what must be reported, when the report must be made, and how counsel and insurers can protect themselves and their clients against potential penalties for reporting deficiencies. 		<description><![CDATA[Vice President Biden and Health &amp;amp; Human Services Secretary Sebelius have recently announced the availability of $1.2B in grants to foster the implementation of electronic health records (&amp;#8220;EHR&amp;#8221;). These grants are pursuant to Title XIII of the American Recovery and Reinvestment Act of 2009 (the &amp;#8220;Stimulus Bill&amp;#8221;). Along with Title IV, these provisions of the Stimulus Bill are referred to as the Health Information Technology for Economic and Clinical Health Act or HITECH Act and provide $19.2B in funding to speed the transition to EHRs.]]></description>

		<description><![CDATA[New Hampshire has enacted two laws this summer that go beyond HIPAA in restricting use and disclosure of Protected Health Information (PHI) and requiring notice to individuals in the event of a breach involving identifiable health information. House Bill 542 (HB 542) was signed into law on August 7, 2009, and establishes requirements related to the privacy of protected health information in a health information exchange. House Bill 619 (HB 619) was signed into law on July 15, and includes provisions that restrict marketing using PHI and adds a new security breach notice requirement for breaches involving protected health information. Both laws go into effect on January 1, 2010.]]></description>
