The radiation and toxic tort group at Blank Rome has a strong record of accomplishment in defending corporate and government clients in toxic tort claims involving:

  • atomic weapons testing and production

The group has experience in areas of:

  • Counseling clients on—and litigating exposure, contamination, and cleanup issues related to—NORM/TENORM and other constituents in oil and natural gas production and processing operations
  • Litigating claims that exposures to radiation from nuclear weapons testing, nuclear energy production, and processing of uranium and depleted uranium caused various diseases, including cancers
  • Preparing and presenting understandable evidence from the highly specialized disciplines of health physics, environmental fate and transport of radionuclides and metals, bioeffects, toxicology, and epidemiology
  • Working with key experts (those who have shaped and led national and international radiation scientific advisory groups) to address myriad scientific issues from multiple, specialized disciplines that are characteristic of radiation cases
  • Successfully limiting unreliable and misleading scientific evidence through pretrial Daubert proceedings
  • Counseling foreign governments that are defending radiation injury claims

Our attorneys are known for providing efficient, focused solutions to complex scientific problems that would otherwise consume extensive time and effort on the part of litigation counsel who are less familiar with the science of radioactive materials. 

In addition to litigating scientific and technical issues, members of the group audit and counsel clients on compliance with environmental regulations applicable to their operations; review and provide comments to proposed regulations that affect their clients; and represent clients in meetings and negotiations with federal and state regulators regarding environmental site assessment and cleanup standards.
