Recent Successes:

  • In criminal antitrust case alleging price-fixing and obstruction of justice, retained to represent former CEO of carbon products manufacturer.
  • Resolved $400 million tort claim in federal court related to formation of a chemical joint venture in which our client allegedly failed to contribute chemical technology sufficient to meet the joint venture’s raw material needs.
  • Obtained dismissal of federal court action seeking indemnification under asset purchase agreement for 20,000 toxic tort claims. 
  • Successfully defended one of the world’s largest energy companies in a class action alleging contamination resulting from radioactive petroleum pipe scale.
  • Obtained jury verdict in defense of suit alleging soil and groundwater contamination and affirmation by state supreme court on appeal. 
  • In a suit involving a tank explosion, retained to represent the tank maintenance business.
  • Conducted internal investigation resulting from alleged misconduct of senior corporate officer.
  • Represented senior executives in significant white-collar litigation.
  • Served as class counsel in shareholder dispute in federal court.
  • Obtained seven-figure verdict in representation of patent holder in an enforcement matter involving method for sterilizing alcohol.
  • Obtained a nuisance-value settlement for a chemical manufacturer sued by numerous students and teachers of a school located adjacent to a plating operation that had been criminally charged twice for allegedly releasing, mishandling and improperly disposing of hazardous substances.
  • Successfully represented chemical manufacturer purchasing building block chemicals from third party in dispute concerning chemical supply agreements


We routinely host educational seminars for the benefit of our chemical industry clients.  Most recently, we hosted a full-day CLE entitled “Significant Legal Developments Affecting the Legal Industry” on December 8, 2009.  Emergent antitrust litigation and product liability litigation issues were among the many topics we covered.  We also addressed the myriad issues arising from internal corporate investigations.


Our antitrust litigators are regularly called upon to provide antitrust counseling and advice to chemical manufacturers, purchasers, sellers, transporters, importers and exporters related to joint ventures, governmental investigations, mergers, acquisitions, divestitures, potential monopolization issues, supply agreements, and trade association participation.
