Presently, we are serving as national coordinating counsel for one of the largest chemical companies in the United States and have been successfully advising them in connection with 100 lawsuits that have been filed in 16 states involving product liability claims and environmental claims related to the gasoline additive MTBE. 

Other noteworthy recent representations include:

  • Successfully defended chemical exporters in enforcement actions brought by the U.S. Commerce Department.
  • Obtained a landmark sales-tax refund for a manufacturer of organic and inorganic catalysts in the purchase of utility services in New Jersey.
  • Obtained a favorable civil settlement in a multimedia criminal environmental litigation matter involving a chemical manufacturer and formulator.
  • Obtained a dismissal of charges against another client and its senior management who were accused of violating federal process safety requirements and also assisted them in defending a cost recovery action for inappropriate-response actions by a state environmental agency.
  • Assisted a pipeline owner in responding to various spills, defended tort claims relating to such spills, and recovered the client's response costs for spills from pipeline ruptures caused by a municipal highway department and by a fallen power line. 
  • Represented a public chemical company in defense of a $300 million claim by a partner in a failed joint venture company.
